Duties Description Representing the Retirement System at administrative hearings
• Assemble, review and prepare case files in preparation for administrative hearings.
• Evaluate cases, interview clients and analyze and prepare cases for trial/hearings.
• Research legal issues utilizing relevant legal authorities and research tools.
• Draft cogent legal arguments, briefs and motions for administrative evidence rulings.
• Write in a clear and convincing manner: memoranda of law, research and opinion memoranda, and correspondence.
• Present oral arguments and conduct direct examinations and cross-examination of lay and expert witnesses in administrative hearings.
• Respond to rules of evidence arguments made by opposing counsel.
• Travel, primarily in New York State using both public and private transportation modalities, occasionally overnight, to attend meetings with other retirement systems and/or hearings.

Miscellaneous Legal Task
• Review and provide responses to subpoenas, records requests, powers of attorney, trust documents, estate papers, and guardianship orders, submitted to the Retirement System.
• Review and prepare legal documents, supporting documentation, legislation, and/or regulations.
• Handle and provide responses to requests to review member folders.
• Review settlement agreements and collective bargaining agreements to advise on the pensionability of salary and service.
• Assist in recovery cases by drafting and reviewing subpoenas, drafting write-off memos, filing estate claims, and drafting letters for the referral of the recovery cases to the Attorney General’s Office.
• Conduct legal research in various areas of law that impact the Retirement System.
• Provide legal opinions to the administrative bureaus regarding the law, regulations, and the Retirement System’s policies and procedures.
• Assist in the design and development of the new NYSLRS pension administration system.
• Handle various special assignments.

Non-Competitive Qualifications for appointment under the NYHELPS Program:
• For appointment to the Assistant Attorney 1 you must have: Law school graduation and/or eligibility for the NYS Bar Admission.
• For appointment to the Assistant Attorney 2 you must have: Admission to the NYS Bar.
• For appointment to the Assistant Attorney 3 you must have: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.
• For appointment to the Senior Attorney, you must have: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.


Competitive Minimum Qualifications:

Position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.
• Assistant Attorney 1 (Grade 18): Law school graduation and/or eligibility for NYS Bar Admission
• Assistant Attorney 2 (Grade 20): Admission to NYS Bar
• Assistant Attorney 3 (Grade 22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience
• Senior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience

Candidates hired at the trainee level will advance to the full performance Senior Attorney SG-25 following the successful completion of the traineeship.

70.1 Transfer:
For a 70.1 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 70.1 title allocated to a salary grade 23 or above.
52.6 Transfer:
For a 52.6 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 52.6 title allocated to a salary grade 23 or above and must have 12 months as an Assistant Attorney 3 OR admission to the New York State Bar AND 24 months of subsequent satisfactory legal experience.

Appointments via transfer must not result in a second, consecutive transfer with an advancement of more than two S-grades or one M-grade.

Additional Comments Knowledge, skills, and abilities:

Attorney admitted to practice in New York, or eligible for the NYS Bar Exam
• Excellent written and oral communication skills
• Excellent legal research skills and ability to analyze legal issues
• Experience in conducting administrative hearings
• Trust and Estates, Guardianship and Powers of Attorney experience
• Knowledge of or experience with administrative law

Telecommuting: The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s primary residence location, duties, and work performance are aligned with telecommuting and operational needs they may be allowed to do so. Generally, OSC employees may telecommute up to 5 days per pay period but may be approved to telecommute less.
